Balfour Beatty Rail Maintenance

Balfour Beatty were awarded Rail Infrastructure Maintenance contracts in Kent and Great Eastern by Railtrack PLC in 2001.  Zaheer Zakaria was engaged to act as an interface between the Commercial and Finance departments, with a view to be able to compare actual costs incurred as reported and maintained within the financial ledgers to Income applications for costs incurred, as raised to Network Rail for payment, by Quantity Surveyors within the commercial department.

To achieve this, the following services were provided:

  • Designed & implemented Cost Centre and Reporting Structure. Chart of Accounts & project/ activity-based coding
  • Interrogated Balfour Beatty Rail Infrastructure Services monthly applications for payments to Network Rail (annual application in excess of £70 Million) to ensure the applications captured full cost exposure
  •  Highlighting areas that may have been underapplied for and also reported on over-measured risk.
  • Prepared and Developed data management solutions to support Contract and Procurement teams
  • Developed and implemented processes that enabled reconciled analyses of actual costs within Mentor in order to achieve Cost Value Reconciliation reports.Established and implemented an excel interface for the commercial department to enable access to detailed costs schedules relating to labour plant and material expenditure.

Kehoe Rail Services Limited

(Previously known as Bridgens)

Zaheer was engaged by Kehoe Rail Services as a Commercial and Finance Consultant. During this time he provided the following services:

Commercial Management and Project Controls

    • Provision of a “cradle to grave” commercial function for all contracts, managing the delivery of projects within the contractual frameworks, which included pre-award procurement and post-award contract administration. Monitoring compliance with contract obligations and driving value from the supply chain
    • Analysis of contract terms to underline areas of risks associated with ambiguities or other instances of inconsistencies and divergence that may exist and make recommendations of mitigating provisions to limit the effects of the identified risks
    • Responsible for setting up project controls using WBS reports, Status Reports, project tracking, progress reporting, change & configuration management. Ensuring time-efficient and cost-effective integrated project plan /programmes and reports were developed, through effective interaction with the project and construction teams, active monitoring of progress, identifying mitigation measures, establishing formats/filters to clearly identify deliverables and targets. Identifying performance against ‘baseline’ programmes

Bid & Tender Management & Business Development Activities

    • Provide direction of the commercial function of the business; responsible for bids and proposals across the UK and accountable for securing new business to meet growth and financial targets at the required levels of profitability, by means of providing a commercial lead in individual bidding projects
    • Drive new ideas and concepts, investigating the potential for establishing collaborative partnerships
    • Develop and document commercial strategies associated with rates, prices and incentive schemes for inclusion in tenders, gaining the buy-in of members of the management team

Business Financial Planning & Reporting

  • Liaise with the MD and senior managers to drive the financial performance of the business and create a long-term financial plan aligned to the business strategy
  • Provide relationship management with invoice discounting facility providers ensuring compliance to the agreement i.e., submission of detailed monthly reports and audit management – pre-audit preparation & post-audit review

Business Analysis

  • Work with internal clients, challenging their ideas on managing process improvement initiatives
  • Oversee the introduction of the final business process design solution
  • Establish a culture of continuous improvement through advocacy and methodologies of Six Sigma

London City Airport

Both Nicola Boriel and Zaheer Zakaria provided an independent and unprejudiced review of the Contractors’ Claims for Variations, preventing the Employer from incurring in excess of £10 Million of Costs.  This was successfully done within six months of them being engaged by London City Airport.

They provided the following services: 

  • Critical reading, reasoning/analysis of factual technical evidence contained within the Contract and Works Information
  • Complete interpretation of the Scope of Works detailed within the Contract and the Works Information including contractually assigned design responsibilities and fitness for purpose obligations

  • Providing leadership and guidance on contract administration matters, including, ensuring that the project teams are managing contracts in accordance with policies and procedures
  • Critical evaluation of data, which was accepted by independent external technical experts and the legal team engaged by the Employer
  • Critical review, analysis and implementation of the Clients Contract Administration Processes which enabled the client to negotiate a £50 million interim settlement with their Tier 1 Piling and Decking Contractor
  • Interface with legal teams and expert external advisors on matters of precedent, contract interpretation and Dispute management
  • Agreeing legally binding arrangement with terms that should be capable of interpretation in accordance with its ordinary meaning without reference to extrinsic evidence
  • Assisting the Project Manager to administer the Piling and Deck Contract

Olympic Delivery Authority

The Games Act 2006 established the ODA as a non-departmental public body with a statutory obligation to develop and build new venues and infrastructure to deliver the 2012 London Olympic Games and Paralympic Games and to maximise the benefits after the London Games from all things done in preparation for them. It was envisaged once the purpose for which ODA was created was fulfilled it would be dissolved. With this, in view, the aim of ODA’s commercial close-out (CCO) programme was to substantially close out all pre and post Games contractual arrangements by March 2013.

Zaheer Zakaria was contracted to ensure timely and robust closeouts were achieved to enable the ODA meet its obligations. To have in place binding and clearly documented commercial and legal closeouts of all contractual commitments with a clear and complete audit trail, to meet the standards expected of a public body. Zaheer provided guidance to Contract Managers and Project Leaders on requirements and expectations for closing out contracts. Ensuring contracts, whether directly or indirectly managed for which the ODA had a contractual obligation or liability were closed out in accordance with ODA’s Contract Close-out policies and principles. Zaheer was also responsible for providing Value for Money (VFM) assessments and tracking existing and emerging risks. This included:

  • Assessment of contractual, commercial and financial risks such as time and cost impact on the overall Olympic programme of latent defects that emerged, where there were significant performance dispensations or quality issues
  • Disputes, where there were pending significant delays and loss & expense claims
  • Identification of outstanding legal/commercial issues that could affect the contract being closed out and consideration of Legal implications that could either emerge or remain open in the close-out period.
  • Impact on Legacy / Transformation / Facilities Management Period
  • Identification of reputational issues of contracts that had a special public interest that was not value dependant. And Identification of risks where contract terms & conditions were considered ambiguous
